Terms & Conditions

These terms and conditions form an integral part of your hire contract with LZAF Limited trading as Marquee2Hire, hereinafter referred to as the “Company”. The registered number is 7674862. Registered Office is Unit 2 Thornhill works, Billingshurst Road, Coolham, West Sussex. RH13 8QN.
Definitions
The “Hirer” is the person whose name & address appears at the top of the hire contract of which these terms and conditions form a part. The hirer must be at least 18 years old. The Hirer accepts full legal liability for all the equipment listed on the hire contract(s) irrespective of whether the equipment is for the Hirer’s personal use, or that of another member of his/her party, booking under the same contract booking number. “Equipment” includes Marquees, Gazebos & any other item(s) hired by the Hirer from the Company. The hire period is the date from which the equipment is collected/received by the hirer from the Company or its agents, until the date that the hirer is due to return the equipment. Both these dates are clearly stated on the hire contract.
Conditions of Hire
1. When the hirer receives their hire contract it is the hirers responsibility to check the details of the contract especially the dates of hire, delivery address and details, of the equipment you have hired. The company will allow the hirer to change the details once free of charge after you have completed your booking, subject to the equipment still being available.
2. The Hirer or his/her agent will sign a receipt for the equipment on collection or delivery. The Hirer or his\her agent acknowledges that they have inspected the equipment and confirms that it is the equipment ordered & that it is in satisfactory working order and condition.
3. The Hirer accepts full personal liability for the equipment from the time they receive it from a member of the Company’s staff or agents, until it is returned to the Company at the end of the hire period.
3.1 The hirer shall not remove any labels from and interfere with the equipment, their working mechanisms or any part of them and shall take reasonable care of the equipment whilst on hire.
3.2 The hirer will take adequate and proper measurers to protect the equipment from theft, damage and or risks such as adverse weather.
3.3 Where the hire goods require fuel, oil/or electricity ensure that the proper type and or voltage is used.
4. Replacement Costs The Company reserves the right to charge the hirer the full replacement cost of such equipment if it becomes damaged, lost or stolen during the period of hire, or until it has been returned to the Company. In the first instance if possible, we will only charge for the replacement parts and labour to repair the damage otherwise the replacement costs are as follows:

5. Pitching of the Marquee/Gazebo. If a charge has been made by the company for Pitching / dismantling the Marquee/Gazebo, the fee includes the labour to erect said item(s). It is the responsibility of the hirer to:
5.1. Make sure the site is clear of services to a depth of 1 Metre of Gas, Electricity, Water and drainage pipes any damage caused if present will be the responsibility of the Hirer.
5.2. There is at least 1 Metre of spare area around the circumference of the Marquee. The Company will still endeavour to pitch the Marquee where there is insufficient spare area, the Company cannot be held responsible for any damage or making good to garden beds, plants or other such property.
5.3. The distance between the Companies delivery vehicle being able to park and the installation site is no more than 30 metres and is a level, clear path, otherwise additional charges may apply.
5.4. The site will be clear of all obstacles and debris on the day of installation.
5.5. The site will be clear of people and animals during installation.
5.6. No BBQ’s or gas patio heaters will be used inside the equipment
5.7. That any build-up of pooled rain or snow is removed from the canopy by the hirer.
5.8. All possible steps are taken to avoid injury or damage to the equipment including climbing or hanging from the framework of the marquee.
5.9. No smoking is allowed inside the Gazebo or Marquee
5.10. Once the Marquee/gazebo has been pitched and the company has left the site. It is the responsibility of the Hirer to check that the equipment remains secure, especially in high winds over 25MPH and that all straps/guy ropes are checked on a regular basis.
5.11. In extreme cases of severe wind/storms it might even be necessary to lower the Marquee/Gazebo down by removing or lowering its legs.
5.12. In the event of severe adverse weather, it may not be even possible to pitch/strike your Marquee/Gazebo. In this situation the Company will liaise with the hirer and delay the pitch to a more suitable time. If the delay continues into the following day and additional staff costs are required, then this will be borne by the Hirer. It is good practice for both the Hirer and Company to assess the weather conditions prior to the pitch/strike and discuss alternative plans.
5.13. The Hirer should keep any part of the equipment that is a framed structure completely closed and secure while not in use during the period of hire.
5.14. The Hire charges do not include any making good or repairing of damage to the site.
5.15. The Hirer is required to provide the contractor with either a plan showing the position in which the equipment is to be erected or should have a representative on the site for that purpose. In the absence of both then the company having erected the equipment where they think fit shall be deemed to have completed the contract.
5.16. The Hirer should never presume that any of Company’s equipment will be attached or joined to any buildings within the site unless previously agreed with the company.
5.17. When chairs/tables are delivered by the company to the hirer, the company will only deliver the equipment inside the marquee and does not set them out. The Hirer can request they are laid out, but an additional fee is charged by the company prior to the delivery of said equipment. At the end of the hire period, the hirer is to re-stack the chairs inside the marquee, otherwise a charge may be levied by the company.
5.18. Where the hirer, hires out Electrical equipment such as lighting / heaters then it is normal practice that the hirer will provide the suitable electricity supply including any extension leads to the said equipment. This can be supplied by the company by prior arrangement to the pitching of the Marquee / Gazebo and additional fees are charged by the company.
5.19. The Hirer is responsible for giving notice to or obtaining permits from any authorities who are or may be concerned and must take application where necessary to the Planning Authority, District Surveyor, Police, Fire Brigade and any similar authority or organisation. Any costs incurred in delays or modifications in the work arising from the absence or misrepresentation of all such necessary permissions and permits shall be payable to the Company by the Hirer. Where appropriate obtain a licence from the Local Authority. Any requirements under the licence must be notified to us in writing, at least 28 days prior to erection. Should the Company for any reason be unable to comply with these requirements, then the Contract will become void and the customer advised accordingly.
5.20. The company will allow the hirer to decorate the equipment with any decorations it deems fit for their function on the understanding that they are completely removed including all tape and or other materials before the company takes down the equipment. If this is not done prior to the company arriving on site to dismantle the equipment, then possible charges may be applied. The hirer is also fully responsible for any damage or staining of the equipment that may be caused by said items of decorations.
6. Amendments. The company will allow the hirer to change the details once free of charge after you have completed your booking, subject to the equipment still being available. The company will not accept any changes 7 days prior to the start of the contract. All amendments must be in writing and sent by post, or e-mail to the Company. Any subsequent amendments will be charged at £10 per amendment.
7. Payments. If the booking is more than 6 weeks from the date of hire. The company will accept a 20% down payment of the value of the contract. This reserves the equipment for your event and covers the work carried out by the company to date. This is NON-REFUNDABLE in the event of cancellation. The balance is payable 30 days before the date the hire commences. If the booking is made 6 weeks prior to the start of the hire, then the full balance is payable at the time of booking.
8. Cancellations. If the booking was made by Telephone or the Internet then the Hirer may cancel the contract up to seven working days after the contract was made and will receive a full refund of monies paid, provided that the cancellation is in writing and sent by post, or email to the Company. Where the equipment has already been dispatched by carrier or to the location the hirer is due to pick up, then the Hirer will be liable for the costs of the dispatch and return of the goods. In such circumstances, the equipment must be returned unused to the Company, and within seven days of its receipt, or normal hire charges will apply. The following cancellation charges will apply:
8.1 No refunds will be made for cancellations made within seven days from the commencement of the hire period.
8.2 Cancellations made between 8 to 20 days before the commencement of the hire period are subject to a fee of 35% of the value of the hire contract, (subject to a minimum charge of £30 for Gazebos & £100 for Marquees).
8.3 Cancellations for Marquee hire made 20 days or more, before the commencement of the hirer period are subject to a fee of 20% of the value of the hire or £40 whichever is greater.
8.4 Covid-19. If after the hirers booking your event is prevented from going ahead due to a Government restriction place upon it because of Covid-19, the Company will allow the hirer to postpone their booking for up to 12 months from the date of the original hire without the loss of the hirer’s monies paid to date.
8.5 If extreme weather is forecast or experienced during the hire & set up period, we have the right to decline the erection and use of the structure. This is for the safety of all concerned. Hirers will be liable for the full hire fee in the event of late cancellation due to weather. As the hirer you must be aware of this possibility especially during the winter months.
9. Changes to the hire equipment. It is possible that the equipment which you have pre-booked may have been lost or damaged by the previous hirer.
In either event, the Company will endeavour to provide the Hirer with equipment of at least the same quality & value as that ordered by the Hirer. Should the Hirer not wish to take the alternative equipment offered, he/she will be entitled to a full refund in respect of the missing equipment. However, the Company accepts no further liability.
10. Returning Equipment Late. If the equipment is returned after the return hire date printed on the contract, the Company reserves the right to charge the Hirer at the daily rate of hire for each day the equipment is late up to the replacement cost of the equipment, as specified in paragraph “4” above, together with any legal fees or associated recovery costs.
11. Deposits for Gazebo Hire. For all equipment that is collected by the Hirer and erected by the Hirer we require a minimum £100 Deposit at the time of booking. If the equipment is, damaged beyond repair, damaged, or dirty beyond normal wear and tear a fee will be deducted from this deposit. See Terms 4, 13 for indicative charges.
12. Damage Waiver Insurance for Marquees Erected by the Company Only.
For all hirers where the marquee is erected by the company, the company offers a damage waiver insurance at the rate of 7% of the total value of Hire.
All equipment supplied by the company (except exclusions listed below) is covered against accidental damage, theft, vandalism, fire, explosion, storm & tempest.
Any claims over £500 will incur an excess of £100 to pay. The Damage waiver Insurance cover will exclude the following:
The following items are NOT covered by damage waiver:
12.1 EC32 Heater and its components,
12.2 Any equipment that is hired in through a third party such as Toilets, Generators, Sound Systems, Staging, Decorations and Catering equipment.
12.3 In the event of extreme weather and the company cannot erect any structures then no hire fee is refunded, and this is not covered by the damage wavier insurance.
12.4. Theft or Vandalism not immediately reported to the police and the company within 24 hours of discovery of the event.
12.5. Deliberate damaged caused during hire period by the hirer or party guests.
12.6. Damage caused by decorations or items attached or not attached to the equipment by the Hirer or a third party.
12.7. Damage to any personal property or any equipment not supplied by the company.
12.8. Damage caused by smoking inside the Marquee.
12.9. Any damage caused by the Hirer or guests moving the Marquee or any equipment during the hire period.
12.10. Any disappearance, unexplained or inventory shortage.
12.11. Consequential loss
13. Cleaning of the Gazebo & Marquees. Whilst we accept it may not be possible to fully clean the gazebo/marquee before returning it because of the weather conditions. The company reserves the right to charge a cleaning fee of £20 per gazebo and £50 for the marquee if the equipment is returned in a dirty state and must be fully cleaned
14. The Company reserves the right to refuse to hire equipment to any client with whom it does not wish to enter a contractual relationship. The Company reserves the right to cancel a contract at any time & without notice, whereupon it will refund to the hirer any monies paid. Following such a refund, no further liability will exist between the Hirer & the Company.
15. Save as provided in these conditions & to the extent that the exclusion or restriction of liability may be prohibited by statute, the Company will not be liable for any loss, damage or injury caused, directly or indirectly by the equipment or its use. Your statutory rights are not affected.
16. FORCE MAJEURE. While every effort will be made by the Company to carry out any order accepted the full performance of it is subject to variation or cancellation by the Company consequent upon Act of God, War, Strikes, Riots, Lockouts or any other disturbances. Fire, Flood, Storm, Gale or Tempest restrictions on the use of Transport, Fuel or Power. Requisitioning Storage of material or transport or labour or any other cause beyond the control of the Company.
17. Additional terms when Toilets are hired through the Company
17.1 There must be level and firm ground for placement of the Toilets with easy and enough access for both the toilet unit and delivery vehicle.
17.2. Capable of supporting the weight of the toilet unit both during the installation and during delivery/collection (Toilet units can weight up to 3 tonnes).
17.3. The company cannot be held responsible for any damage to the site on which the unit is placed or damage to the site involved in the delivery or collection of the unit
17.4. No decorative tinsel, crepe paper or self-adhesive material to be affixed to the toilet units without prior arrangement.
17.5. NO Naked flames i.e. candles or similar are to be placed in the units
17.6. Once the unit is in situ & set up and company staff have left site and you now wish the unit to be relocated there will be an additional charge of £175 plus vat to re-attend site, unset the unit and reset the unit at new location.
17.7. It is the responsibility of the Hirer to meet our staff on arrival at the site, alternatively, to mark the ground or send a detailed plan or drawing beforehand. (A charge would be made for waiting time).
17.8. No guarantee can be given that the equipment will be removed the following day. The company will do its best to meet the wishes of the hirer whenever possible.
17.9. The Hirer is responsible for all waste which enters the holding tanks until ownership of the waste passes to the company upon collection. The company accepts NO liability for any environmental issues caused by overflowing tanks
17.10. Cleaning charges will be added when portable toilet units are blown or tipped over
17.11. In adverse weather conditions it may not be possible to position the toilet unit on grass or similar surfaces. Alternative arrangements for the placing of the unit should be in place before the arrival of the unit itself.
17.12. The Hirer is responsible for obtaining any necessary permits for the delivery of the Companies equipment on the site, including those required by Companies staff to obtain access to the site.
17.13. The Hirer is wholly responsible for any loss or damage to the equipment whilst on site or otherwise in the possession of. In the event of any loss or damage however caused the hirer agrees to indemnify the Company for the full cost of any repair or replacement of the equipment.
